The above picture shows a motor vehicle entering a four-lane undivided highway. There is a bicyclist in the bike lane. Who should yield the right-of-way in this situation, the bicyclist or motorist?
The Answer: MOTORIST
In this instance the motorist should yield the right-of-way. The vehicle merging is always the vehicle that yields right-of-way unless a sign states otherwise.
This answer is based on Idaho state code 49-640 (1)(2)(a)(b).
