The Question:

The above picture shows a motorist that has just parked their car and are exiting the driver’s side of the vehicle. A bicyclist comes “out of nowhere” and slams into the door. There is no bike lane. Legally, who is most likely responsible for this crash?

The Answer: Motorist

The motorist is most likely the culprit in this scenario. It is the legal responsibility of the motorist to ensure the way is clear of passing bicyclists. Of course a bicyclist should also pick a travel lane that keeps them out of the door zone.

This answer is based onĀ Idaho state codeĀ 49-607.
