The above picture shows a pedestrian walking on a two-way two-lane highway. The pedestrian is facing the traffic. There is no usable shoulder or sidewalk. Legally, is this where the pedestrian is required to be?
The Answer: YES
A pedestrian walking on a two-way two-lane highway should always walk on the side facing traffic. If there is no usable shoulder or sidewalk, the person should carefully walk on the outside edge of the roadway.
This answer is based on Idaho state code 49-708 (3).
