The Question:

The above picture shows a driver and bicyclist beside one another waiting at an intersection with a stoplight. The driver is planning to turn right. The bicyclist plans to go straight. The light turns green. Who should yield the right-of-way?


The Answer: Driver

The driver is to yield the right-of-way in this instance. The bicyclist has preferential right-of-way if going straight when the driver is turning right. This scenario, however, should not happen. A turning motorist should not pull up along a bicyclist that has not signaled he is also turning. Also, a bicyclist should not pull up alongside a motorist who has signalized he is turning.

In this instance, the safest path for the cyclist is to merge into the middle of the land behind the turning motorist.
